We provide service to you, subject to the following Terms of Service, which may be updated by us from time to time without notice. By accessing any page on this site, you agree to be bound by these terms and conditions. By placing an order with China Printing Online, you agree to the following terms:
Acceptance of Orders – All orders are subject to acceptance by the seller. Acceptance of orders is based on the expressed condition that the Buyer agrees to all the terms and conditions contained herein. Orders accepted by Seller may not be cancelled without Seller’s prior written consent. The acceptance of this order is conditioned on Buyer’s assent to terms and conditions herein which are different to those presented by Buyer.
Quotations – Estimates and quotations are only valid in writing and for a period of 30 days from the date of the quotation unless otherwise agreed to in writing by Seller. All price terms set forth in this Agreement shall constitute good faith estimates only and shall be conditioned upon review by Seller of any artwork / samples supplied by Buyer. Buyer agrees to pay the prices in effect at the time of shipment. Seller’s prices do not include special packaging or finishing (unless specified in quotation), sales tax, use tax, insurance, duties, customs fees, or shipping. Unless specified all pricing is FOB Shenzhen, China.
Artwork – All artwork, designs and images must be provided in minimum of 300 DPI and CMYK format. China Printing Online is not responsible for any color shift that occurs in conversions from RGB to CMYK color modes. China Printing Online is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.
Order Approval – Customer is fully responsible for final proof and layout approval prior to the printing process. China Printing Online is not liable for errors in a final product caused by any of the following reasons: Misspelling Errors, Punctuation Errors, Grammar Errors, Graphics Orientation or Placement, Incorrect Fonts Usage, Wrong Die cuts or slits, Incorrect or Missing Folds, Finished Product Size.
Copyrights and Trademarks – The customer warrants that are have the right to produce the subject matter to be printed, duplicated or distributed. If the subject matter is copyrighted, the customer warrants that it owns the copyright or has express permission of the owner to reproduce the copyrighted subject matter, and that it has not removed any copyright notice from any material to be reproduced without written permission. You may not place or reproduce any trademarks, service marks, or logos that are not owned by you or licensed to you onto materials and merchandise to be printed via the China Printing Online service. Words, names, and designs used to identify services or products are considered trademarks, service marks, and/or logos. The same policy is applicable for copyrights. You cannot use unlicensed copyrighted materials from photographers, artists, publishers, composers, writers, and other authors of original works. The copyright owner’s exclusive rights prohibit the reproduction of any original work. China Printing Online policy also states that you cannot use explicit language or pornography on printed materials and merchandise.
Cancellation – Once Seller has either accepted a Purchase Order or begun activities to satisfy a Purchase Order, the Purchase Order cannot be canceled, terminated, or modified by Purchaser in whole or part except with Seller’s consent in writing and then only upon terms and conditions to be agreed upon. Purchaser shall indemnify Seller for any costs incurred, including material and labor costs, in connection with any Purchase Order that Purchaser desires to cancel, terminate, or modify.
Samples – China Printing Online may use your product for samples or advertising purposes, unless notified in writing of its inability to do so. In the event of a written notice, China Printing Online will cease its usage of your product within 30 days of receipt of the notice. Any usage of the product for samples or advertising purposes prior to the receipt of the written notice will be deemed as acceptable.
Under/Over Run – Over-runs or under-runs will not exceed the percentage specified in the contract. Stickers China will bill for actual quantity delivered within this tolerance, that is 10% over or under.
If you require a guaranteed quantity, the percentage of tolerance must be stated on your purchase order.
Warranty – China Printing Online warrants that the goods sold are of merchantable quality at the time they are delivered, and are manufactured in conformance with the buyer’s specifications, drawings or other description and that China Printing Online conveys good and marketable title to them, subject to China Printing Online security interest. Except as expressly provided in this agreement, China Printing Online excludes all express or implied warranties, conditions and obligations of China Printing Online, whether statutory, oral or otherwise, concerning the quality of the goods or their fitness for any use or purpose. China Printing Online specifically, but not by way of limitation, does not warrant the accuracy or sufficiency of any advice or recommendations given to the buyer in connection with the sale of goods. China Printing Online assumes no risk nor will it be liable for any damages whatsoever resulting from the application or as a result of the use of the merchandise included herein.
Returns and Refunds – For printing color there is a 10% allowance on colour variation, as well as 3% allowance on quantities due to errors in any production process. This will not deem as grounds for requesting for a reprint. Since each order is unique to customer and has no re-sale value, all sales are final. If we verify that we made an error, we will re-print the order. Customer must notify China Printing Online within 5 business days of order acceptance to notify any defects discovered in the ordered product. Note for reprints, no changes on reprint item, we will bear all the cost.
Title and Risk of Loss – All products shall be shipped F.O.B Seller’s plant and shall become property of Purchaser upon delivery to carrier. Buyer shall assume all risk and liability for loss, damage, destruction, or misuse of the product by third parties who may acquire the products illicitly after delivery to the carrier. However, the right to stop delivery in transit shall remain with Seller until payment in full has been received by Seller.
Delivery – Any dates quoted for delivery of the goods are approximate only and China Printing Online shall not be liable for any delay in delivery of the goods howsoever caused.
Force Majeure – Seller shall not be liable for damages as a result on any delay or failure of delivery due to any cause beyond seller’s control, including but not limited to: acts of God, acts of Buyer or any of its representatives, statute, ordinance, regulation, order or other governmental action, fire, accident, strike, slowdown, riot, terrorism, war, delay in transportation or inability to obtain necessary material, fuel, or labor whether involving Seller’s employees or the employees of others, and regardless of the fault or responsibility on the part of the employer. In the event of the occurrence of any of the foregoing, the time for performance shall be extended for such time as may be reasonably necessary to enable Seller to perform. Delay of delivery in any shipment shall not relieve Buyer of its obligations to accept such shipment or any other shipment.
Taxes – All taxes, duties, and excises of any nature whatsoever now or hereafter levied by any governmental authority, whether federal, state or local, both directly or indirectly, upon the sale, use or transportations of any goods sold hereunder shall be paid and borne by Buyer.
